These Terms of Service ("Terms") govern your access to and use of 2sms ("the Service"), operated by 2sms ("we," "our," or "us") at 2sms.ai. By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
2sms is a business SMS notification platform. It allows you to upload documents (PDF, CSV, Excel), extract job or dispatch details using AI, and send personalized SMS messages to workers or recipients. The Service includes document storage, AI-powered field extraction, SMS delivery via Twilio, reply management, scheduling, team collaboration, and related features.
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
One account may be used by one business entity. Fleet plan accounts may add team members, who are subject to these Terms. You are responsible for your team members' use of the Service.
You must be at least 18 years old to create an account.
You agree to use the Service only for lawful business purposes. You may not:
We reserve the right to suspend or terminate accounts that violate these terms, send spam, or engage in activity we reasonably believe is unlawful, without prior notice.
You are the sender of record for all SMS messages sent through your account. You are solely responsible for:
We provide automatic opt-out processing (STOP keywords) as a technical feature. This does not constitute legal advice or guarantee TCPA compliance. Consult your own legal counsel regarding your specific SMS marketing obligations.
You agree to indemnify and hold us harmless from any claims, penalties, fines, or damages arising from your failure to comply with SMS regulations.
New accounts start on a free Trial plan with limited SMS sends, documents, and recipients. No credit card is required.
Paid subscription plans (Starter, Growth, Fleet) are billed monthly or annually in advance. Subscriptions automatically renew. You may cancel at any time; your plan remains active until the end of the current billing period. We do not provide prorated refunds for unused time on a cancelled subscription.
Credit packs are one-time purchases. Credits do not expire. Credits are non-refundable once purchased, except where required by law.
Subscription plan limits (docs/month, SMS/month, recipients) apply as described in our pricing page. Exceeding plan limits will block further sends until the next billing cycle or until you upgrade. We do not automatically charge overages without your consent.
We may change prices with at least 30 days' notice. Price changes take effect on your next renewal date. Continued use after the effective date constitutes acceptance of the new price.
If a payment fails, we will retry it via Stripe. After repeated failures, your account may be downgraded to the Trial plan. You will be notified by email before any downgrade.
You retain all rights to documents you upload and messages you send. By uploading documents, you grant us a limited license to store, process (including AI extraction), and display that content solely to provide the Service to you.
You represent that you have the right to upload and process all content you submit. Do not upload documents containing third-party intellectual property, confidential information you are not authorized to share, or personal data without appropriate authorization.
Fleet plan accounts may access the 2sms API using Bearer tokens. API usage is subject to rate limits described in our documentation. You may not use the API to create tools that compete with 2sms or to resell API access to third parties.
Webhook endpoints you register must be your own infrastructure. Do not register webhook endpoints to receive data belonging to other accounts.
We aim for high availability but do not guarantee uninterrupted access. We are not responsible for downtime caused by Twilio, Stripe, Supabase, SendGrid, Anthropic, Vercel, or other third-party infrastructure providers.
We may modify or discontinue features of the Service at any time. Material changes to core functionality will be communicated with reasonable notice.
You may delete your account at any time by contacting us at legal@2sms.ai. We may suspend or terminate your account for violation of these Terms, non-payment, or activity we reasonably believe is harmful, fraudulent, or illegal.
Upon termination, your data is deleted per our Privacy Policy. Outstanding balances remain due. Provisions that by their nature should survive termination (indemnification, limitation of liability, dispute resolution) survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT AI-EXTRACTED FIELDS WILL BE ACCURATE. YOU ARE RESPONSIBLE FOR REVIEWING ALL EXTRACTED DATA BEFORE SENDING MESSAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR TCPA PENALTIES ARISING FROM YOUR USE OF THE SERVICE.
You agree to indemnify, defend, and hold harmless 2sms and its officers, directors, employees, and agents from any claims, damages, fines, and expenses (including attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or third-party rights, including TCPA claims related to messages you sent; or (d) content you upload or transmit through the Service.
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under JAMS rules in Phoenix, Arizona, except that either party may seek injunctive relief in court for intellectual property or confidentiality matters.
You waive any right to a jury trial or to participate in a class action lawsuit against us.
We may update these Terms. Material changes will be communicated by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
